1. Acceptance of Terms
1.1 Agreement
nextWithUS ("Platform", "Service") is a brand and product of Cromtek Solutions Pvt. Ltd. By accessing or using the Platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
1.2 Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts. By using nextWithUS, you represent that you meet these requirements.
1.3 Changes
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance. We will notify registered users via email for material changes.
2. Accounts & Registration
2.1 Account Creation
You may register as a Job Seeker, Employer, or Freelancer. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
2.2 Accurate Information
You agree to provide accurate, current, and complete information during registration and to keep your profile up to date. Impersonation or misrepresentation is strictly prohibited.
2.3 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, post fraudulent listings, engage in harassment, or otherwise misuse the Platform.
3. Job Seekers
3.1 Free Tier
Job seekers may create a profile and submit up to 5 job applications per month at no cost. Additional applications require a paid plan.
3.2 Profile Content
You retain ownership of content you upload (resume, portfolio, bio). By uploading, you grant nextWithUS a non-exclusive licence to display your profile to registered employers.
3.3 Accuracy
You must not misrepresent your skills, experience, qualifications, or identity. nextWithUS may remove or suspend profiles found to be fraudulent.
4. Employers & Job Listings
4.1 Posting Requirements
Job listings must be for genuine, existing roles. Listings must include an accurate salary range, location, and role description. Misleading listings will be removed without refund.
4.2 Prohibited Listings
You may not post listings that require upfront payment from candidates, involve illegal activity, discriminate on protected grounds, or violate applicable employment laws.
4.3 Verification
Employer accounts are subject to verification. nextWithUS reserves the right to request company documents and to revoke the Verified badge if documents are found to be false.
4.4 Internship & Fresher Posts
Posting internship and fresher (0–1 year experience) roles is permanently free. Other job types require a paid plan after the first free post.
5. Payments & Refunds
5.1 Pricing
Paid plans are billed monthly or annually in Indian Rupees (INR). All prices include applicable taxes unless stated otherwise.
5.2 Payment Processing
Payments are processed by Razorpay. By purchasing a plan, you agree to Razorpay's terms of service. nextWithUS does not store raw payment credentials.
5.3 Refund Policy
All subscription plan purchases are final and non-refundable. Once a plan is activated, no refunds, credits, or pro-rated amounts will be issued for unused periods, early cancellations, or mid-cycle downgrades. By completing a purchase you acknowledge and accept this policy.
5.4 Plan Changes
Upgrades take effect immediately. Downgrades take effect at the end of the current billing cycle. No partial refunds are issued for mid-cycle downgrades.
6. Prohibited Conduct
Scraping & Automation
You may not scrape, crawl, or use automated means to access, copy, or collect data from the Platform without prior written consent.
Spam & Harassment
Sending unsolicited messages, spamming candidates or employers, and any form of harassment or abuse are strictly prohibited and may result in immediate account termination.
Intellectual Property
You may not reproduce, distribute, or create derivative works from nextWithUS's content, trademarks, or code without express written permission.
Interference
You may not attempt to gain unauthorised access to any part of the Platform, introduce malicious code, or interfere with the Platform's integrity or performance.
7. Intellectual Property
Platform IP
nextWithUS and its licensors own all rights to the Platform's software, design, branding, and content. Nothing in these Terms transfers any IP rights to you.
User Content
You retain ownership of content you submit. You grant nextWithUS a worldwide, royalty-free licence to use, display, and distribute your content solely to operate the Platform.
Feedback
Any feedback or suggestions you provide may be used by nextWithUS without restriction or compensation.
8. Disclaimers & Liability
No Guarantee of Employment
nextWithUS is a platform that connects job seekers and employers. We do not guarantee job offers, interviews, or successful placements.
Platform "As Is"
The Platform is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.
Limitation of Liability
To the maximum extent permitted by law, nextWithUS's total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the 3 months preceding the claim.
Third-Party Links
The Platform may contain links to third-party websites. nextWithUS is not responsible for the content or practices of any third-party sites.
9. Governing Law & Disputes
Governing Law
These Terms are governed by the laws of India, including the Information Technology Act 2000, the Digital Personal Data Protection Act 2023, and applicable rules thereunder.
Jurisdiction
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
Grievance Redressal
As required under applicable Indian law, our Grievance Officer can be reached at team@nextwithus.in. We will acknowledge complaints within 24 hours and resolve them within 30 days.
